So i took ownership of my Austral on the 15th July and handed over the Astra i had. Just got a letter from Derby City Council to say i was driving the Astra in a bus lane on the 26th July, 11 days after i handed the vechicle back.
Who do i contact about this?

I would suggest contacting the council, and challenge the ticket, as you where no longer the driver/keeper of the car, because you handed over the car to the dealership on what ever date it was that you had the hand over.
Do you have the paperwork from the dealership? This is eveidence that you where no longer the keeper of the car. From that date, you were not responsible for the car.
Also might be worth running it by motability customer service to see what they say. Oh and then pay a visit to the dealership and roaster their arses. It’s their problem.

Do this as quick as you can. The fine will escalate if unpaid and becomes a lot more hassle to get reversed.
August 2, 2024 at 1:54 pm #286116Spoken to Motability, they are sending a letter out with the details of my handback date then i’ve got to send that to Derby City Council.
Also spoke to the dealership and they said the car had gone by then (picked up by Motability) so don’t know who’s driving it.

i can relate to this issue as in 2021 several members after handing back my Vw GTD(Motability) and happily getting around in my vehicle when I received a notice for being in a bus lane in Birmingham (I stay in Glasgow)and never been to Birmingham however I explained this to Birmingham city council but it took sometime to resolve even after contacting Motability and sending relevant paperwork and I also received a final notice and a letter from their solicitor to pursue but i spoke to dvla and they said there was delays due to the pandemic 🙄but after quite a bit of stress it was resolved but a total nightmares 😡

Let them waste all their resources all their time and money. This happens every day because motability are not informing the DVLA that they have sold the cars.

So this motability customer has to do all the running because motability did not inform DVLA that they had sold the car. This happens every day in life with motability they just don’t do a simple job on a computer to tell someone that the car is no longer there’s. And if he contacted DVLA a couple of days later you can be assured it will be out of his name then ok.

I agree that Motability have messed up, but the harsh reality is that until the change has been made the previous driver will be the one who gets any fines and is accountable for them until such time as they can prove that they no longer had the vehicle at the time. These things can be easily resolved by doing as I suggested, which @Retro89 has now done.
The solution that you proposed of just ignoring it is not sensible for a multitude of reasons. Fines have a habit of escalating if not paid quickly. Police issued fines will progress to Magistrates if not paid and then you incur court costs and potentially bigger fines as well. Many other fines are civil matters and the escalation levels can involve debt recovery agencies. Nobody in their right mind wants to have all that worry hanging over them, or the hassle of having to get things overturned once they’ve been escalated, especially when a quick call to Motability and sending the proof that you weren’t responsible for the car at the time gets it resolved very quickly without any of that hassle.

Agree with Glos Guy, if you do what is suggested by belfast4 you are simply building a whole lot more stress than you already have. Of course its Motability who should be dealing with it but!!

The DVLA data would show the ‘Registered Keeper’ (not owner) in the following (example) format:
Mr Fred Bloggs
(c/o Motability Operations 01654).
123 Anyroad Street
Anytown
AB1 1AB
With the address being that of the keeper – not Motability’s address.
The part in brackets simply confirms it is a leased vehicle and who leased from, but may not form part of the data given to certain third parties.
So, councils/police etc etc would send all correspondence to the registered keeper by name at the registered keeper address.
Obviously with DVLA being somewhat tardy in updating records, no doubt at the time of the offence, it was still showing the OP as the registered keeper.
August 7, 2024 at 2:54 am #286363Got the letter from Motability today. One sentence that says when my lease started and ended, then a bunch of stuff about how they can’t contact the council about the penalty charge on my behalf due to legal reasons.
Just copied that letter and put it with the penalty charge appeal form, wrote down that i was no longer the owner and they should contact Motability about it.
Still want to know who was driving that at this point, i live in Nottingham and handed the car to Renault Nottingham who confirmed the car was picked up before the date in question. Did Motability already sell the car on at that point?
