JIMHi peeps
I have just had the decision on PIP that I’m going to be on standard rate for both entities.
What a blow, I scored 9 for personal care and 8 for mobility. I’m upset to say the least!
They said I can ask for a reconsideration but how does that work. Has anyone had any experience with this? I have to give up the car, I’m broken ?

I told them on the form I preferred the assessment at my home as I cannot use pay and display machine in carpark I cannot move my fingers 3 years ago a beautiful lady doctor came out to my bungalow

jimthank you all soooooo much for the information given on here! i have just asked for the assessors report and should receive that shortly. Should i get my doctor to write me a report?
does anyone have any good solicitor names they have used in the past?

Regarding solicitors. Save your money and use a CAB advisor if possible

I myself have had a home visit on being transferred from DLA to PIP whilst being in bed due to pain and fatigue. Just received the letter giving my only 6pts on Daily Living & 4pts on Moving around. This despite being in Chronic pain due to long term Osteoarthritis as well as Heart problems and Diabetes. Have requested Mandatory Re Consideration and Health Report. Being prescribed moderate pain relief (30/500 Co-codamol 2 x 4 day) + Capsaicin Cream to effected joints is not enough. The explanations seen in my DWP letter are littered with untruths on my Mobility and activity levels. Supported by my GP hope I will be one of the 14% (rate of success) fortunate ones. Have to hand the car back otherwise as going to appeal takes over a year to be heard I’m told. This update might help my position and many others….
Update from Benefits and Work 02-10-2019
This week the DWP updated their guidance to health professionals carrying out PIP assessments. It contains a positive change for claimants who have to live with Chronic Pain like myself. Up till now Heath Professionals have been free to make the assumption that people who are not prescribed Strong Pain Killers can’t be in much pain! So any claims that Pain limits their activities can be ignored. This looks to be what has happened in my review.
However, the new guidance tells them that “the level of analgesia used does not necessarily correlate with the level of pain.”
The guidance points out that GPs are encouraged not to prescribe strong painkillers for long-term pain because of the harm they can do the patient.
In addition, some patients may be intolerant to analgesics or they may be using other methods of controlling pain. ( as in my case using Capsaicin Cream) I also have difficulties with some of my meds making me Dizzy, weak and drowsy.
Health professionals are told that instead of relying solely on the amount of medication as evidence, they should expect the claimant to be able to describe :
The location, type, severity and variability of the pain they experience and the impact it has on their daily life.

PhiljbA lot of people panic about PIP assessments, but if you follow the help and advice available, keep all medical letters, not appointment letters, for evidence.
Remember everything you do or say is evaluated. So give short answers if you can.
All questions in your assessment are based on the application form you sent them.
so make a copy and look at it again before your assessment, then the questions won’t catch you off guard.Personally I’ve heard plenty of horror stories, but my experiences have been fine.
I would also only get a solicitor involved if your case is very complex in which case CAB will likely have a list of recommended firms.

I have received my letter today and am still awaiting the assesors report.
I am shocked to read the letter… its like they assessed someone completely different in the room, i was so down that day that the assessor said forget doing the physical movements as i was in alot of pain,yet in the report it says ii managed them fine! Just by addressing a few points that they have made a mistake, i would get the higher rate. The system is broken as am I.

PhiljbJim were you alone for your face to face?
If you have any medical evidence of why the physical exam would be impossible for you, you should have nothing to worry about.
But highlight all incorrect points and let them know why it’s wrong, with your supporting evidence if possible.
My report also had contradictions in it, but it didn’t matter as I got enough points. I’ve never heard of anyone say their report was totally correct.

get him to put in writing that he witnessed you couldn’t carry out the physical examination and what the assessor said.
let them know you’ll go all the way to a tribunal unless it’s corrected along with your score.Again include all relevant medical evidence, stating why it’s impossible for you to do it.
Also phone and tell them you disagree and why.
your assessor has obviously made mistakes.
