I had some good news on Motability refusing me an offsite handover the Ombudsman has voted in my favour and quite frankly wonders why motability are breaching the Equality Act. Although even Motability tell you to go to the Ombudsman it may still not be cut and dry as I think Motability have not even responded to the Ombudsman which they gave them up to 12th may with no response it maybe that Motability do not like to lose.I will let you know the outcome.

HarryQuite astonishing that Motability adopt this belligerent and unhelpful stand.
Flexibility must be at the core of their work.
Otherwise they’re no better than a ( choose your own utility company)!

If you sign up to a contract, and dont abide by the terms of the contract then it cannot be discriminatory.
I would hazard a guess that you must be present at a garage to sign off the handover and due diligence.
As always, there are rules to handover a £30,000 vehicle and to make sure it is done safely and correctly.
If you cannot meet the requirements of the contract why sign up for it in first instance?
Motability do give quite a bit of latitude in their business, and there is prbably more to this than meets the eye.

Personally I have always found Motability flexible and accommodating, I am inclined to agree.
Unfortunately I have suffered a brain injury and occasionally I get confused and often say the wrong thing.
May 17, 2023 at 10:17 am #221609Absolute Rubbish you should have the same choice as able bodied people who can order from home have demo if needed and have car delivered, and also WAV and Mobility Scooters can be ordered from your home and have them delivered under Equality act Motability has to offer Reasonable Adjustment otherwise it is Discrimination false dot.
May 17, 2023 at 2:16 pm #221629@Berty it states or did prior to covid on Mobility website you could have an offsite handover of your new vehicle as long as your dealer agrees as they would need an escort following to take the driver back once delivey has taken place!. This is also the case for WAV’s on the scheme.
An able bodied person can have a home handover of a Rolls Royce and customer pay the same due diligence at their home premises. The same applies to lease companies who often deliver the vehicle with the aid of a 21st century tablet or pda to complete and finaise any paperwork. So whether car costs £30k or £100k makes no difference.
Remeber people have all kinds of disabilities including hidden disabilities that fall unduer the equality act, so disabled are not put at a disadvantage.
The fact Motability allow you to order and to have WAV’s delivered or are you saying those to are able bodied to get to the dealership in a wheelchair, to take handover of their new vehicle and pay due diligence.
Apart from my daughter’s physical dsability, she is also massively on the spectrum anf I can fully understand where Dave is coming from. If I’m not mistaken it was initially agreed for Dave to have an offsite handover!

March 2, 2024 at 7:42 am #259978Hi Tim, is there any updates to your off site handover? I’m going through the same thing. I have agoraphobia and can only drive around my hometown. I ordered the car via phone from a dealership about 25 miles away from me, they were happy for the offsite handover but motability declined my request. Who should I contact to try and sort this out please? I hope you managed to get the car you wanted in the end.
March 2, 2024 at 7:45 am #259983March 2, 2024 at 9:58 am #259992Hi Guys It seems that Motability has an Elite team lol to make decisions on what I call ordering and having car delivered by a dealer that is happy to do this, I was told this team is uncontactable unless they contact you which sometimes they do and sometimes they don’t. The Ombudsman told me why do you even tell Motability? and I told them because it seems now a lot of dealers have been old to not do this unless they ask permission from the Cartel which when they advertise being able to order Mobility Scooters from home and WAV and have them delivered apparently we cannot. Motability say as well you have to order a car first and then ask them for offsite handover as they call it which is ludicrous why would you place your order for something you cannot have should it not be before you order as you may have put a deposit on the Car and signed a contract with the dealer which if they could not deliver the car to you they would be in breach of contract so Motability are putting dealers in a worrying position.The FNS Ombudsman said what are Motability playing at in Breaching Equality law and this is what you guys will have to do unless you have a no win no fee lawyer or enough money to take the Cartel to stop this unjust dogma they have.

To be honest I found some Peugeot dealers offering order and delivery and some that said they have never heard of having cars delivered under Motability The one I have found does is subject as you have to tell motability to this Law they have as it will cause the dealer to get in trouble. It is very stressful and caused my health to go down hill to every time you go for your new car to explain this as it should be free to disabled who are unable to visit and collect there car, everything that is done at a dealership can be done on the salesman laptop he brings and the looking over the car and even an adoption’s installer like mine can demonstrate them to you at your home. In Fact it is better at your home for some of us it is more relaxing and gives you more time to look over the car with space around it as I have and never had any problems and even the salesman have gone over and over things if you are unsure. It used to have on find a dealer on Motability website home visits but strangely they disappeared a few years ago I do have one theory as one dealer told me they used to pick up and deliver your car if you had problems or a service and he told me Motability no longer pays them for this service and it would cost you more than £40 so is this another cut without telling us.

Thank you for the link btw, I veiwed a car (Honda ZR-V – Hyrbid) which is a lot cheaper to run than the Honda Civic 2020 I currently have at the moment and also received during the lock-down when handovers were allowed. Motability have said I can keep the Civic until 2025, but I cannot afford to run it any more as my Daily Living with PIP has been cut. I need a car though, as I can’t afford to buy a new or 2nd hand one.
