Insurance claim (allegedly)

      Hi just after some advice, got a letter from RSA saying that an Accident occurred at a certain place at a certain time. and it is an offence not to stop for an accident and they will be reporting this to Motability.

      The only thing is we have not ever had an accident and if we had we would certainly have stopped!

      We were at the place and day that the alleged accident occurred but we definitely did not have an accident or hit any other car.

      This was 3 weeks ago so our front and rear dashcam has been overwritten, and if there had been any sort of impact then it would have recorded it and saved it to a special folder that does not get overwritten.

      They asked for, and I sent pictures of the car showing no damage apart from a trolley basher that scratched the front wing 2 years ago.

      My point it we seem to have been told off and reported to Motability even though we have done nothing wrong. I have sent all the information asked for with absolutely no clue as to who is saying we hit them and what evidence they have. I get the feeling from speaking to RSA that they are just going to accept the claim from the mysterious individual who is claiming without telling us anything about the alleged incident so we can at least defend ourselves.

      As this is our first (alleged) accident with RSA Motability in over 10 years, has anyone gone through this and can offer some advice?  thanks Jon

        It sounds like another party has put two and two together and got 5 there Jonny, either that or it’s just a plain case of pulling a fast one. I would ask what evidence has been presented to RSA which makes them assume you’ve been involved. You have a right to any information pertaining to you and I would insist on it. Also, if the place you were located at the time of this alleged incident has CCTV then you could ask for a copy to show you weren’t involved. Good luck with it though. ?

          This is the sort of thing that can happen under the British Millennium Justice Act of 2000, section 10, subsection 22b, “All UK citizens are guilty of everything until they can prove their innocence at great cost to themselves”.

          Only joking of course but that’s how a lot of things seem these days. ???

              Sounds like it could be a case of fraud, A false claim, if you are sure you did not do anything i would suggest talking to Rsa again and then the police as fraud is a criminal matter.

                I feel your pain. I went through this some years ago when someone claimed my wife’s 3 month old Micra had managed to write off their Honda Accord in a car park, despite there not being a scratch on her car.

                How a plastic bumpered purple Micra could write off an Accord by hitting its chrome steel bumpers and not leave a scratch is quite something. The damage to the other car was a completely destroyed wing, headlamp etc and bent chassis member, hardly superficial.

                We fought with our insurers, Direct Line, for several weeks, all to no avail, they paid the claim & billed us for the excess. We think it was settled that way as the other driver was also with Direct Line.

                In life, it's not who you know that's important, it's how your wife found out.

                  Thanks, I don’t understand why there is no info forthcoming? At the end of the day all that will happen is I will have to pay the excess but it does seem unfair and I am slightly worried that they say they will report me to Motability for not stopping after an accident (that I never had) I wont take it lying down though!

                    This happens all the time, if for example a car opens a door and hits your door and leaves a mark you do not need to confront the other person. Get their reg number make of car and report it to your insurance company, they will then initiate a claim against the other party’s insurance company. Most of the time this will be paid with no problems, I would say someone has had something done to their car and they have taken your reg number and reported it.

                    if you are sure you have done nothing wrong tell RSA under no circumstances are you to pay the claim and that you have reported it to the police as insurance fraud.

                      Thanks for all your comments, I am going to fight this as I know we never hit anyone and I would like to see some evidence from the claimant. Will keep you posted:-)

                        It’s annoying because the insurer chooses how to settle the claim in regards to liability. Even if you contest it they may still allow/disallow the claim.

                          Knock for knock has been the corner stone of the car insurance industry ever since I’ve been driving in the 70’s.

                          Can’t see that changing anytime soon because the only winners are the insurers.

                            This happened to my sister a couple months back, insurance company didn’t even try fight it, as far as they were concerned she did it and a claim went against her.
