Orchard WAV CarsHi there,
We’re just wondering, how many here are having or have had problems with the PIP Claims process?

My first time, I was awarded zero and had to go through a full year+ for the appeals process where it was overturned and my award was granted. I have since had a single re-assessment where it stayed the same. Personally I believe I should be on a higher rate for daily living than I am, but the honest truth is, financially, we’re ok so I don’t intend to fight for it. Anything I can help you with?

PhiljbThe PIP process is just too slow initially and the questions they set and the assessors way of deciding points isn’t fit for purpose.
people with incurable and degenerative conditions are being let down too often by staff not qualified to understand them.
That’s why such a big percentage win on appeal as your case is looked at by experienced doctors.
February 9, 2020 at 6:07 pm #105999Yup to that, my wonderful condition is BOTH incurable and degenerative and now they’re asking you NOT to use those words – personally I don’t take any notice of it, and stick to the prior requirement to tell the truth – they can’t say Tell the truth but dont say this, if “this” is the truth…

WinstonMy pal is a nurse ( NHS ) she is always telling me that there are assessor jobs going for the various companies that do these assessments and that they pay very good money compared to NHS
I can’t repeat on here what I tell her but believe me there is a lot of beeping lol
i know a job is a job but like defence lawyers getting scumbags off free on a technicality with they are guilty as sin! as a human being you need to put your conscience first
it was a real eye opener to me when I first had apply for it , horrible system
February 9, 2020 at 8:55 pm #106033It annoys me that the assessors never have to turn up and face the music at the appeals court and nor do the DWP come to that.
When I arrived at the court for my appeal in 2017 the court clerk said it’s was very rare for the DWP to turn up.
They’ve got no guts what so ever and hide themselves behind telephones calls and postal letters in brown envelopes.

AnonymousOn the plus side if DWP fail to turn up at appeal then it will deemed that they are unable to defend their version of events and well supported application coupled with well supported evidence usually wins the day in my own 10yr experience

PaulColin..You say yours stayed the same?did you fill in the new AR1 form putting the same or worse?the questions are doing my head in conditions same but bad days are worse than before.Describing the issues in words onto forms is so hard.(well for me anyhow)
Sometimes i think easier if they do come and see me face to face, but then they never seem to listen.I get why people think “sod it “the finacial benefits dont counter the stress the process put people through.

GeorgieJust a ‘heads up’ that may or may not affect your response to this subject – Orchard WAV cars is a business that sells second-hand WAV vehicles. I think they’re fishing for potential business from people who lose their PIP.

AnonymousWhen I first needed support at the time I had a choice of opting for the DLA or apply for the new PIP
As DLA was at the early stages of being phased out I opted to go for PIP
I could have gone for DLA a year or so earlier but I waited until I had undergone and exhausted all of the conservative treatment options made available/offered to me.
Also being on ESA I was aware that I should be in the support group and not WRAG so I waited before applying for PIP until this was possible
Prognosis was made ( some 5yrs after seeking initial treatment) and on the strength of this I asked for a ESA super-session which thankfully then placed me in the HIGHER support group
I gathered as much supporting medical evidence from as many people as I could
On the strength of this I then applied and won my PIP award
Always remember fluctuating conditions will attract a shorter award as thing can get better as well as worse
If an assessor tells lies then complain directly to the company that employs the assessor do not get distracted by this and quickly move on with countering those lies with strong supporting evidence as just proving a assessor to be a liar will not win you an award
Never accept an offer for an over the phone application always go online and seek a DWP SAR request ( Subject access request) they will if asked send you all past info that they have about you ( can be an eye opener ) at the very least it will give you a detailed insight that can be very useful
Good thing is this request is free and they have 40 days to send this out to you so always best to ask for this asap as may well prove useful in future reviews
I could write so much about all of this but I have touched on the main points
February 9, 2020 at 9:56 pm #106041Because my original claim went to appeal, I wasn’t offered a renewal, I had to apply again as if it was a new application so there weren’t any same or worse type questions. I got lucky (vaguely at best) as my old award ended and the new one started a week later so it didnt make any real difference moneywise, we were just £50 short for about a week

imo the AR1 needs to be WELL SUPPORTED thoroughly answered ( attache extra sheets if needed with as much evidence as was given when first application was made.
Always be clear detailed and leave nothing open to interpretation ( In the absence of evidence or fact their training is to interpret as they see things which will often fail to reflect true events)

Thanks for making that clear although the question itself is a good one and I am sure one that will allow those affected to express their own personal experiences

PhiljbI’ve just filled out my wife’s AR1 form for her before Christmas and she had her award extended without a face to face.
I would recu you should always fill in an answer to all of the questions even if it’s just repeating why things haven’t changed and follow it up with any evidence you have.
The more information and evidence you can send the less likely they are to dispute what you say.Add extra pages and accounts from friends family members or Carers help a lot. Oh and don’t forget your name and NI number on the top of each page you add and make copies of everything you send for future reference.
I had a 10 year award of higher for both so I’m not expecting a brown envelope through my door any time soon.

bfoandcWas on DLA Higher for Mobility since 2000. Over next years (and numbers of medical reports) care was added and I was given an indefinite award. Had to apply for PIP in 2017. Initial decision was lower care and lower mobility. I went to mandatory reconsideration (as not all evidence considered and report not consistent/clear on some points) and was awarded higher care and higher mobility.
In October I filled out the AR1 form and in January was told I’d be having a f2f assessment. This happened and my great misgivings about the ‘assessment’ on the day, were proved correct when I read a copy of the report. I don’t have a decision yet but if the decision maker follows the assessment report I will get no PIP at all!
I’ve complained to ATOS (Independent Assessment Services) and made my MP aware and will be sending a copy of the complaint to the DWP. I’ve decided that if PIP is removed I will go to Mandatory Reconsideration and Appeal if needed. My current award ends anyway at the end of March.
