Penalty charge notice

      I need some advice please. Me and my partner and son were driving through Lytham yesterday. I needed toilets due to a bowel and bladder condition. I parked on the main road on a double yellow lines as we were headed over to the toilets there was a traffic warden about 20 feet from the car I asked him if it was OK to park there and he asked if I had a valid blue badge displayed I said yes and he said yeah no problem I could park there. Got back from toilets 20 minutes later and guess what I had a penalty charge notice on the windscreen. I have never had a parking ticket and don’t know were I stand or what I can do. Has anyone else had this happen to them.

        Assuming there were no kerb markings preventing you from parking with your blue badge, you will have to follow the appeals process outlined on the PCN.

        If the PCN was issued by the local authority it’s usually a pretty quick and simple process. If it was issued by a third party operator it can be more difficult. It took us over two years to get a PCN from a motorway services overturned.

          When you came back to the car did you take a picture of where you were parked showing the double ;ines and your blue badge displayed.

          I had a PCN when on holiday for parking on what I thought were double yellow lines, but when the PCN came through it stated I parked where no parking was permitted with the double yellow lines at right angles on the pavement. My photo showed they wern’t visable where I parked so got the PCN cancelled.

            If kerb markings, as stated it would be an appeal where you can state the warden said it was ok to park there. If the markings were there he should have also advised you that a colleague of his might come along and ticket it though if they weren’t aware.

            If no kerb markings, the ticket should have a phot attached (not physically) of your whole windscreen and badge (or lack of) included.

            Again, appeal and ask to see this as part of the process.

              I once got a local authority parking ticket overturned. I was parked in a loading bay with badge displayed, the loading bay stipulated 5 minutes only, got a ticket as I was there an hour. I found a really obscure court case where a disabled person successfully argued that it takes them more time to get their wheelchair out and set up, so the 5 minute rule was not in the spirit of the law. I appealed and quoted the case, the ticket was cancelled.

                Did they include a photo?

                Out of interest, many moons ago, I got a parking ticket which was for Unnecessary Obstruction. What does your ticket say the reason is?

                  If you asked the traffic warden and they said you can park there then you should write this in your appeal.

                  Most council always reject your appeal first time round. Also contact the CEO of the council and tell them what happened also mention the Equality Act and tell them you will sue for disability discrimination (failure to make reasonable adjustments) if they dont cancel the PCN. As you are disabled and you needed the toilet or you would soil yourself this would count as extenuating circumstances.

                  People who break down and get a PCN get it cancelled. So being disabled and needing the toilet should get it cancelled. If they dont then tell them you will go to the papers.

                  Your best bet would be to contact the CEO(executive management team).

                    Also if you dont pay and bailiff come you dont have to let them in. Bailiffs colect payment for PCN dont have powers to forse entry. But they can come through unlocked doors. They shouldnt come through windows but some may try.

                    They can clamp a car but they cant clamp a  car displaying blue badge or a car on finance. So they cant take a motability car.

                    Also if you are vulnerable they should go away.
