PCN in a disabled bay

      Hi everyone,

      i recently received a parking charge notice from a company called nexus for £60 if paid in 14 days or £200 thereafter and I immediately appealed the charge as I was in a disabled bay and had explained i definitely displayed my blue badge and also explained my circumstances including being a double leg amputee but the next day i received an email stating my appeal was rejected?

      I was parked at Livingston shopping centre but have never experienced having a ticket as I had been parked for 2.5 hrs and 2 hours i think was the allowance but displayed my blue badge?

      should i pay it?

        @kdwolf I agree. I managed to get one overturned as well but, in this case, I’m still unclear whether the fault lies with the car park operator (in which case an appeal is well worth it) or the OP (perhaps misunderstanding that time limits also applied to Blue Badge holders), in which case I’d just pay the £60 and chalk it up to experience, infuriating though it is.

          I agree – there was no clear and concise statement on chain of the events so far: if the ticket was purchased,  if images were produced by the company etc.

           

          But it is down to the person,  who began this thread if they want to provide the facts or just looking to filter their frustration out.

            Hi everyone,

            Thank you to everyone for their replies and advice.

            The facts are I parked up placing my blue badge on display before exiting the vehicle.I returned 2.5 hours later and there was no indication of a ticket.

            A fortnight later I received a PCN on the post indicating a fee of £100 or £60 and I immediately appealed to the parking operator and next day received an email saying my appeal was rejected.

            i did state I was unaware of an additional ticket requirement when using my blue badge as I’ve never experienced this in Glasgow or elsewhere when parking?

            I also made them aware my reasons for having a blue badge being a double leg amputee,type 1 diabetic and receiving dialysis and sent photos of my badge and number.

            I then found i could appeal through popla but then also realised I can’t pay the reduced fee of £60 whilst this appeal is ongoing and as the decision may be longer than 14 days that means if again rejected I pay £100!

              @Footloose Apologies if it’s just me and I’m being thick, but I’m still not clear about why you got the ticket! Was it because you thought it was free parking for Blue Badge holders when it wasn’t? If so, you might struggle with an appeal, unless you can demonstrate that the signage was unclear.

                Hi Footloose

                Following on from my previous reply the  Livingston Designer Centre do not allow free parking for Blue Badge owners. There are signs unfortunately that state Blue Badge owners should ‘pay and display’. If you did not purchase a ticket there is no point in appealing. Their cameras take a photo of your car/registration plate entering and leaving the car park. I had also purchased a ticket and still received a fine for buying a ticket in the wrong ‘zone’ and parking over two bays in the snow, best to pay it and move on save all the stress.

                  my intention after the advice received from the forum was to pay and learn from my genuine mistake however when i tried to pay the £60 it wouldn’t accept the £60 as the operator knows I have a second appeal through popla and the only acceptable payment is £100 but the reply from the operator was to await a response from the second appeal decision and at best it will be removed but more likely the £100 fee will have to be paid as it’s likely the decision will be longer than 14 days which is the time allowed for the £60 fee.

                    @Scotty Thanks for clarifying that. Makes sense now. It’s difficult to provide advice when the facts aren’t clear or complete! It’s a hard lesson in not assuming that all car parks provide free parking for Blue Badge holders. Many privately owned ones (which Livingston clearly is) don’t allow free parking for Blue Badge holders. Parking in a disabled bay and displaying a blue badge, however severe the disability, sadly doesn’t exempt people from paying if the requirement is to do so. One of the grounds that I used in my (successful) appeal was that the signage was not clear but, from what you are saying, it sounds as though that argument may not wash in this case. I think that @Footloose tried to pay and move on, but the system wouldn’t allow the reduced fine to be paid, which I’m sure has gone in the appeal.

                      Fingers crossed that your appeal is successful. I would hope that if it isn’t you might still be able to pay the reduced fine. It would seem deeply unfair to penalise you for appealing, as that would prevent many people with legitimate grounds for appeal from doing so as they wouldn’t want to take the risk. A quick Google search suggests that some operators “pause the clock” on the 14 days if you appeal. Hopefully Nexus is one of them 🤞

                      EDIT – Just looked at the Nexus website and it explicitly says that if you appeal to POPLA and your appeal is unsuccessful, you have to pay the full £100 and the £60 fee is no longer applicable. It’s no wonder these companies get such a bad reputation 😡
