Hi all,
I received a letter from the police which says they seen me using a mobile phone whilst driving and given me a few options one being accepting the points. I wanted to know will I lose my Motability vehicle if I get the points? I’ve been on the scheme for 5 years

You shouldn’t lose your car, but what other ‘options’ are they giving you? Driver Awareness Courses are usually only available for minor speeding infringements. If they are offering you one instead of 6 points then bite their hand off. 6 points is quite serious, as it should be, but if you can avoid the points you should. There is absolutely no excuse for handling a phone whilst driving, as you could kill someone. Most cars have Bluetooth or similar.

I believe they stopped mobile phone awareness courses in the in early 2022.
December 23, 2023 at 3:45 pm #252163If you do get the 6 points and are looking at a ban, you can, due to your disability, request no ban due to exceptional hardship if car is lost for a period of time.
The Magistratescan still ban you, it’s not a given

December 24, 2023 at 10:32 am #252198I don’t understand how the police can say they seen you on your mobile phone, what proof have they provided. If you were driving and they were driving why did they not stop you.
I don’t think they can just say I seen him/her on there phone without evidence of this. I would be asking for the proof and the evidence of the offence, before doing anything.

December 24, 2023 at 10:58 am #252202I reported a complete moron taxi driver to the police on Wednesday, weren’t interested as I had no video footage. I also rang the taxi company with his car ID number and his badge and reg details, again weren’t interested in the least 🙁
I was stuck behind him doing 22 in a 30 then 40mph limit, constantly going over the centre line, over hatched off areas etc. then onto a busy 60mph dual carriageway doing 40mph and still driving along with a cigarette in his left hand and adjusting his mobile phone sat-nav in the centre of the dash with it. He also had a second mobile on the right side of the dash and was constantly scrolling through photos on it with his right hand then picking it up and showing it to his passenger in the front seat. As I said, complete moron.
Please excuse spelling/typos. Apart from being a clot it turns out I had one on my cerebellum that's now causing various problems!

Ive never been tempted to get a dash cam. There is a tendency for folk to believe that they are faultless in all they do and the dash cam is to provide evidence against others who are at fault. In reality, a lot of people are convicted on the strength of their own dash cam footage!
December 24, 2023 at 9:19 pm #252264Hopefully you’ve learned your lesson. If you take the 6 points penalty and are still under 12 points, then you are fine.
However, anyone using a phone whilst driving deserves 6 points minimum.
Also, I’ve had dash cams (front & rear) for many years. They do make you a better driver, and you can always send footage of dangerous / illegal driving to the Police – they are happy to prosecute.

I do also wonder how its deemed legal and acceptable in many cases to have to take your eyes off of the road when having to navigate the touch screens sub menues
just to achieve a basic but essential task such as demisting the windscreen
Seem imo about as smart an idea as the not so smart Motorways

December 25, 2023 at 12:44 pm #252292A few years ago my Son ran into the back of a white van who had pulled out of an airfield (flying his model planes) and then immediately stopped on a major road to programme his Sat Nav. Why didn’t he do this at the airfield? The van driver never could answer that question. My Son spent a long time recovering from the van drivers lack of thought/planning.
Before anyone sets off on a journey, connect your phone (cable or Bluetooth), set your sat nav (if required), then pay attention to the road and drive accordingly (not the radio/phone/music). It’s really not difficult. I’m trying to not come across as too preachy, and failing.
Drivers taking responsibility for their actions should make the roads safer…
