      My daughter was injured in her motabiliy car which was being driven by her support  worker. No other car involved. She has an open  insurance  policy as her support  worker changes often. Can she claim anywhere for her injuries?

      Thanks in advance for any advice

        Yes, her claim is against the driver, in this case, the support worker. Whatever car insurance the driver has is who you claim from. They must provide their insurance details to your daughter.

        Funnily enough, she may end up claiming against her own Motability policy, if that is who the driver was insured by…

          I was assuming above that the accident was the drivers fault…if, however, it was a third party, such as diesel on the road or a terrible pothole, then the claim would be against whomever caused the loss of control of the vehicle.  Can be more difficult for things like diesel spills, where no one knows who did it.

            Thank you Abercol. Driver was at fault, no other car involved or diesel spills, just lost control. Driver has his own insurance  for his own car but also authorised to drive the motabiliy car thro an open insurance policy for any driver. Thanks
