      Hi all

      My car was involved in a non fault accident  where I was hit in the rear while stationary at a traffic light.

      I have booked the car to get repaired, it is not badly damaged just some small dents and scratches and the rear sensors have stopped working.

      Whilst my car is in the garage being repaired I have been offered a like for like car but not as a courtesy car rather a Credit Hire. Apparently I put my name on a credit agreement and have the use of the car for the duration.

      The car hire company Enterprise will then chase up the insurance of the person who hit me to claim costs. They asked me about my earnings, where the car is going to repaired, who the body shop is etc, questions I found a bit intrusive.

      Here is where it gets weird, Enterprise have stated that if they are not able to recover the cost of hire I am liable to pay.

      RSA have tried to reassure me but I am bit nervous to be honest. Has anybody else had this and if so what was the outcome

        When another driver collides with your car that is not illegaly situated or you do not deliberately stop so as to cause an accident then you are not responsible for costs

          If it’s a Motability car I don’t see why you have had to book it in and deal with Enterprise, RSA once informed of the accident should take car of everything for you, as for replacement vehicle there is no additional charges and the conditions of insurance and excess are the same as your RSA agreement.

            Michael – I was stationary at a traffic light, my engine was off due to the stop/starthe admitted it was his fault.

            JS – it is a Motability car RSA have a new thing in their system where they don’t pay for the courtesy car rather they get hire car companies to give the car us drivers and the hire company then chases the third party for the costs.

              Imran, The Credit Hire company will immediately cover the cost and claim it back from the third party insurance (the person who hit you).

              In the case the third party insurance will not pay out then your insurance will cover the cost. The cost of the hire car will not be coming out of your pocket directly. (Although any claim will result in an increased renewal cost).

              As an aside, if you call your insurance company to ask whether it’s worth claiming or to discuss any minor accident and then do not continue with a claim, it is still considered one and is a termed a ‘Non claim incident log’. This will increase a renewal cost. Mad I know but as I always say, motor insurance is legalised theft.

              ? I will be remembered for nothing but had great fun doing it ?

                Thank you for the information. I was given a prestige car yesterday whilst my car is being repaired. They give a like for like.

                Motor Insurance is legal theft, wow I never thought of it like that but it is quite accurate also made me laugh.

                  Might not apply in this case because RSA do use Enterprise but beware that the car insurance system is riddled with scams and you can never be sure who are the good guy’s or bad guy’s.

                  I say this as last year after being rear-ended within an hour I had someone ring me about a replacement car and at this time having only just got home I hadn’t even informed RSA of the accident.

                  On this occasion simply because I had not informed RSA I knew for sure that the other party involved had contacted there insurance so I simply told the guy it was a Motability car and there is nothing I can do but follow their rules as it’s there car so he swanned off.

                  30 minutes go by and the guy who was driving the other vehicle called to apologise for the other guy who rang and said he told his insurance company not to use these companies that try to save themselves money by leaving out your insurance company, but strange he should say that.

                  So just beware of who is calling you, by the way, I have raised this matter of be chased by compensation companies or whatever they are and the fact they of course know everything about your accident, your name, address like it’s been put in the national press situation vacant section and have said to Motability and RSA that they should have some sort of password procedure for insurance claims that’s agreed between the victim and RSA/Motability on the first call to report the accident.

                    If the third party’s insurance has admitted liability you will be fine, as long as the hire car is of the same vehicle type as your own car.
