I don’t understand how this can happen, Derby Council would have contacted DVLA to find out who was responsible for the car at the time, and with the DVLA data being out of date would have been given Motability’s details, who in turn should have given the council the dealerships details not Retro89’s.
The DVLA data would show the ‘Registered Keeper’ (not owner) in the following (example) format:
Mr Fred Bloggs
(c/o Motability Operations 01654).
123 Anyroad Street
Anytown
AB1 1AB
With the address being that of the keeper – not Motability’s address.
The part in brackets simply confirms it is a leased vehicle and who leased from, but may not form part of the data given to certain third parties.
So, councils/police etc etc would send all correspondence to the registered keeper by name at the registered keeper address.
Obviously with DVLA being somewhat tardy in updating records, no doubt at the time of the offence, it was still showing the OP as the registered keeper.
