You are completely misunderstanding the issue here Ian. I have never said that a contract isn’t legally binding. What I have said is that as Motability customers we never enter into a legally binding contract with a dealer. The only time that we enter into a legally binding contract is on the day that we pick up the car and enter the PIN. At that stage, the contract which comes into effect is between the Motability customer and Motability Operations.
Any order paperwork that you sign is basically just admin so that you and the dealer have agreed the exact model and spec that you want. They use the same paperwork as for a private customer because it’s all they have, but you are not entering into a legally binding contract with them.
