Actual loss, will be that the value of the vehicle is now lower due to the higher than stated emissions and now dfon’t give the performance stated they would, But also imo the bigger claims will be because they was being mis-sold something they knew about and hid that fact. like with all the other mis-selling claims we’ve seen before, claims have been made on that basis, rather than loss.
Personally whatever i think, They have lied and that opens the doors to compensation and law firms taking on no win no fee cases, or class action suits.
Once a case is set in law it sets a precedent. Often though many claims for or against you are settled or dropped out of court by companies as they don’t want that precedent set, or other companies knowing the contractual details and could also open themselves to law suits from their competitor’s, for gaining a market advantage over them by cheating.
a bit like with airbus and boeing, claims and counter claims, who’s really makes money from it all and benefits, those doing the legal work. All civil / County courts really care about is who pays their fees and of couser the law, in this case in the uk i think it’s the consumer laws that will payout over the diesel claims.
We could really all claim against the car companies for mis-stating mgp figure if they wasn’t done by a third party and was done by themselves, as now we have real world figures as opposed to those before you’d never get anywhere near.

Interesting i had a parking notice and fought it as i knew i was in the right, i appealed on the legality, the appeals process found in parking companies favour, Then i got contacted by gladstone brooks, who had board members on both companies and the so called independant panel.
Anyhow a jugde didn’t see it like that and asked questions at which point the case was dropped. Why did the independant body find in the parking companies favour, when it was clear they did not have the legal right to opperate where they was and the notice was issued and i had provided that evidence to them.
Seems this happens alot and all part of the scam, lucky for me i worked in that industry for quite a while and understand the laws regarding parking on the the roads and private land.
Same will happen with many diesel car claims in uk, due to our legal system and they will settle out of court as they know once a court makes a judgement they in more trouble.
