The other party’s insurer is always going to try to argue the toss, even in an open and shut case just to try and save money. If they can throw enough shade on the matter to get DLM to go 50/50 they’ve saved thousands. They don’t care who’s right or wrong, it’s just a numbers game.
Stick to your guns, the fact that the other driver fled the scene (probably drunk) is massively in your favour. Ultimately though the insurance companies will decide between them what the final result is, how it impacts you is immaterial to them and you don’t have any say in what they do.
