Hit and Run Write off help

      Hi everyone, I’m hoping someone can help or explain what might be happening with my insurance claim because I’m really worried.

      In February 2026 my Motability car (a Ford Kuga) was involved in a car crash. I was driving on my side of the road when another driver came around the corner, crossed over the white line and hit the driver’s side of my car. After the crash, the driver abandoned his car and fled the scene.

      The police attended and from the scene they could see that I was the victim and the other car had hit me. I also managed to obtain CCTV footage from a nearby house which supports my version of events.

      DLM Insurance contacted the other driver’s insurer and sent accusations as it wasn’t my fault but now they have come back accusing me of losing control and hitting them, which is completely untrue. DLM are supporting me but seem vague in what will happen if he disputes the CCTV

      My car has been written off, and the total loss team are due to contact me, but I’m really worried about what this means for me.

      I’m still waiting for the police to contact me regarding the collision so I don’t yet know if there are criminal proceedings for his reckless driving (unknown if he was drunk or on his phone)

      I’m also disabled with arthritis and my car is my lifeline, so being without it is already having a huge impact on my day-to-day life.

      What does it mean when the “total loss team” contact you?

      Any advice or reassurance would be really appreciated because this whole situation is extremely stressful.

        Given the third party fled the scene, which is a criminal offence and the police are satisfied you were not at fault (backed up with CCTV evidence), the third party would find it very difficult to dispute especially in a court.

        I’m not sure whether Motabily insurance with Direct Line has legal cover included or you have cover elsewhere, but I’d certainly ask Direct Line if its included so you can pass on the crime reference number and CCTV evidence and let a solicitor deal with it.

        Remember you have evidence, don’t be pushed into admiting liability by Direct Line

          I have next base front and rear cameras, in 2023 a young women with a baby run into the back of our vehicle when we were stationary at red traffic light, the insurer just required the video evidence, they more invested as to whether the baby was securely fixed in.

          Unfortunately I have suffered a brain injury and occasionally I get confused and often say the wrong thing.

            DLM may have an agreement in place (with the TP insurer) that means there will be no uninsured losses. That way, Legal Expenses section will not get involved – it wouldn’t operate how noted in previous comment.

            Very much doubt that police will contact you about the TP driver’s potential conviction(s)

              My point of legal cover whether included or independant is to prevent a 50:50/Split Claim and preserve non fault based evidence.

                Understand your point Kezo but that isn’t what Legal Expenses will cover in a motor insurance wording.

                  The other party’s insurer is always going to try to argue the toss, even in an open and shut case just to try and save money. If they can throw enough shade on the matter to get DLM to go 50/50 they’ve saved thousands. They don’t care who’s right or wrong, it’s just a numbers game.

                  Stick to your guns, the fact that the other driver fled the scene (probably drunk) is massively in your favour. Ultimately though the insurance companies will decide between them what the final result is, how it impacts you is immaterial to them and you don’t have any say in what they do.

                  I’m sure MB will look after you and get you on the road as soon as practicable.

                    Sorry to hear about this. Anything like this is extremely stressful. Given that there is some video evidence and the other driver ran off, it is highly unlikely that you will be held accountable for this claim, as the other driver rather sealed his guilt by fleeing. I suspect that they were under the influence (more likely to be drugs these days) and fled to avoid being tested. If the other driver genuinely believed that it was your fault they wouldn’t have run off, a point which DLM will no doubt make (if they do their job properly).
