callmejohnI know the feeling, with the fat finger’s only too well, Grumps, but I am glad it worked out for you.
I hope that everybody on this forum now know’s that the Government has now conceded that there is no point in reviewing and causing unnecessary stress to existing claimants of ESA (from 2017) and now PIP, who’s condition is severe and lasting, with no possibility of improving, therefor they should no longer have their case reviewed other than a paper review within DWP. In other words claimants in this situation should not be receiving review forms and causing them unnecessary stress.
Unfortunately DWP either seem incapable of understanding that change, in the DWP regulations, or are simply ignoring it and claiming that if a claimant with a severe and lifetime condition which cannot possibly improve with time, can still be reassessed by sending them out an ESA or PIP reassessment form if they have not been reassessed since the act was changed.
I, a 61 (then) year old with Myelomeningocele (the worst form of Spina Bifida) Paraplegic was sent a review form last December in which I had three weeks to return it, by the 25th December 2018 (yes good will to all men on a day that they do not work).
I returned the review form with a letter by recorded delivery (and I would suggest you always send DWP return’s by recorded delivery, if you do not trust them, as if you wouldn’t), well before that date, stating the above change in the Act. You know I still haven’t received a reply from them, so I had three weeks to return their form or my benefit could be stopped, and they have almost 11 month without replying one way or another.
I would be so disillusioned with DWP had I not been an ex employee with them for 27 years.
I you are genuine, then never stop fighting, there policy is to wear you down and remember the majority of Tribunals are won by the claimant, but it does help if you turn up at the Tribunal.

callmejohnSorry, having read my piece, can I just stipulate that my returned form was a filled in returned form, just to make sure that I had returned it in time, even though I was objecting to them sending it out to me in the first place.

AnonymousIt seems like they don’t care about putting people through hell as long as they get their pound of flesh.

Agreed, the years leading up to my DLA to PIP switch I was reading about the nightmares some were being put through and I too became one of those but it really made me angry when time and again some politician would answer to the press when asked about the nightmares they would say “we’ve got appeal system to safe guard disabled folk”.
They just don’t realise how frightening that is for we law abiding disabled citizens who have never seen the inside of a courtroom or to be cross examined by a judge.
The ideal was a good one, after all with DLA there was very little checking for qualification but they went about it like a Bull in a china shop and the main reason for the change looking at it from my point of view is it was nothing more that to cut the benefit and like everything government does, it ended up costing more than what they saved.
November 11, 2019 at 3:05 pm #96099this whole thing shows nobody considered the effects on disabled people I guess we were easy targets
