Stuck123<p style=”text-align: center;”>I don’t know what I’m going to do. I have multiple sclerosis and 2 autoimmune diseases. My review for pip put me on the standard rate, read the assessors report, full of lies. My carer pushed me in with my wheelchair. She said I walked in. Went to Mandatory reconsideration, heard last week not successful and I’m to hand the vehicle back this coming week. I currently have a severe chest infection and am to self isolate. My carer is returning the car for me. I’m distraught. I can’t get food delivered as no slots and without a car my carer can’t go get it for me. Motability said it has to be returned. martinoi am discussed that they do this they quit clearly lie or mix up cases, I hear this type of thing all the time , the bit that pisses me off (sorry) is the claimant fills out the form with ticks the boxes and fills in supporting comments in the box, they get doctors / consultants letters to confirm everything you put on the form
you go for the assessment they ask you question they type up their report on each question, but you dont get to see their report there and then but you dont .
Was the assessment recorded (they were talking about bringing that in ) , there has be so many cases, myself included that they have disregarded medical evidence and what you say and put something else.
You need to go through each question and compare what you put on your form ( hopefully you have a copy ) to what they put in their report and if you can back it up with medical evidence (if you can ).
you want to ask to appeal
To be allowed to appeal to a tribunal, you’ll need:
your letter from the DWP with the words ‘Mandatory Reconsideration Notice’ at the top – if you’ve lost it, ask them for a new one
to send your appeal form in within one month of the date shown on the mandatory reconsideration notice
i hope this might help dont just accept what they say
regards
martin
March 21, 2020 at 4:44 pm #109828Sorry to here this stuck123.
there are lots of posts on PIP etc that can be found by using the search box, one that contains some helpful info is https://forum.whichmobilitycar.co.uk/forums/topic/pip-anyone-been-turned-down/
And information from the Motability site.
March 21, 2020 at 5:09 pm #109831Sorry to read your story stuck123. You are not alone in this lottery that is PIP. How some of these assessors can sleep at night, I don’t know with the lies and inaccuracies they tell.
As JS has link above for you, have a good read of that thread as it contains lots of info and links.

PhiljbThat’s bizarre did the carer just push you to the offices or into the interview room too.
I’ve never experienced lies before there have been some mistakes but nothing too serious, but I read all the time about people having to fight every step.
All you can do is appeal now but I’m guessing with all this shutdown going on it will cause more delays.
can your carer not get a cab with your shopping or do you have another family member who can help.

bfoandcI too sympathise. My first PIP assessment, in 2017, when transferring from DLA wasn’t deceitful as such, more confused and inconsistent. On mandatory reconsideration it was improved. I had an assessment for a PIP review in January. The report was downright deceitful: didn’t list all the evidence I’d presented, was full of omissions, had vague descriptions used as ‘evidence’ and the discounting of anything that supported my description of the problems and their effects. I’ve complained about the assessment and informed my MP as well. I’m waiting to hear what the DWP decision is and my Motability car may also need to be returned.

AnonymousI have been a member of this forum for a number of months now and have commented on a few posts usually car related. I have read many many posts regarding applying for PIP and attending face to face assessments. I have also seen comments about assessors being inacurate with their reports and unfortunately I have also seen coments about Manditory Considrations having a low success rate. I really cannot comment on this but can only give my personal experience. I have never applied for PIP and was only signposted in this direction by a local authority employee when I was appying for a Blue Badge. The first point I would like to make when commencing the process is ‘Do not believe that the DWP will contact any medical proffesionals to verify your claims. I was told on the telephone they will not. Even when their guidance undisputedly infers that they will. A very helpfull (in hindsight not so) councel worker helped me complete the initial application (she scribbled away on the application) but never showed me the final document. But thankfully it was enough to get me to a face to face assessment. I must emphasise i submitted no medical documentation at all as I wrongly thought DWP would request. I turned up to my F2F and was greeted with a very friendly and reassuring (witch) assessor who made me feel totally at ease. I answered everything honestly and again had no documentation from my doctors as i pressumed by this time they had received this. Fast forward letter comes in awarded nothing for either PIP benefit. The assessors report was somewhat accurate and in other respects full of (lets just say discrepencies). I had read the copy of her report I had requested. I applied for a manditory consideration. Sorry for the extremely long introduction but here is the point. I obtained medical reports from my GP and Mental Health specialist and send them to the DWP. Along with a 12 page letter pointing out the inaccuracies in the OH report and more importantly addressing how each of my disabilities affects me . I went into considerable detail. It actually took me almost a week to write as I made sure everything was covered. Long long story short (sorry) I was awarded 15 points for Daily and 14 for Mobility for 3 years and backdated to original date. Please everybody please do not give up. Ask for MR or Appeal but dont rush your representaion. If you cant yourself get someone to help you but you ‘can can can’ go from nil to full award just take your time and read and re read. Wow . That was long but thats beer for you. Fed up seeing deserving people being put off by a far from perfect system and others understandibly (advising its just not worth the effort). Good luck.

AnonymousSorry admin this probably should go on another post for people applying but once I started typing i couldnt stop lol. I just dont want anyone to give up. Thanks

OscarOneUnbelievable. That said however, you must NOT give up!
I appreciate you have requested a “manual reconsideration” and that, that was negative however, that’s just a box ticking exercise by a Senior Case Assessor, your next step is to appeal and you MUST do it.
I have dug out the latest Lifestyle mag from Motability, I quote the following which I hope is of some help;
# If you are not awarded the Enhanced Rate Mobility component of PIP:
Following your DLA to PIP assessment, if you are not eligible for the Enhanced Rate of Mobility Component of PIP, you will no longer be eligible for the Motability Scheme. Motability Operations will be in touch to help you return the vehicle and support you through this transition. You may also be eligible for a pro-rata refund of any Advance Payment you made. When the vehicle is returned, you will not have to pay any further lease payments.
# DLA – PIP Transitional Support for Scheme customers:
There is a package of financial support available if you are a Scheme customer who previously received DLA payments and have been unsuccessful in your PIP reassessment, as long as you return the vehicle to the dealership in good condition and by the agreed date. Transitional Support is only applicable for Scheme customers who are unsuccessful following a DLA to PIP reassessment and does not apply to PIP – PIP reassessments.
# Stopped Allowance Support for Scheme Customers:
For a period of three years from September 2019, Motability (the charity) has committed to support Scheme customers who lose eligibility to the Motability Scheme as a result of a stopped allowance following reassessment, such as PIP – PIP, or those who joined the scheme from 2014 onwards who would not receive the transitional support payment. Through the Stopped Allowance Support Group Programme, Motability will help scheme customers with a payment of £1,000. Powered Wheelchair and Scooter Scheme customers can apply for a smaller payment, which will give them option to buy their Scheme Wheelchair or Scooter.
# Who Can Receive Stopped Allowance Support:
Scheme customers who are unable to continue to use the Motability Scheme as a result of losing their qualifying benefit following a reassessment will be eligible. This includes: PIP – PIP, DLA – PIP (where they are not eligible to receive a grant from Motability’s Transitional Support Programme), DLA – DLA.
The payment will be available if you return your car in good condition to your dealer, and on or before the date agreed with Motability Operations. Please note you cannot receive both Transitional Support and Stopped Allowance Support.
# How do I claim Stopped Allowance Support?:
When the DWP stop your allowance, they will notify the Motability Scheme. As long as your car is returned to your dealer in good condition, within the agreed timescales agreed with Motability Operations, you will automatically receive a cheque for the £1,000 grant in the post. You do not need to apply for Stopped Allowance Support.
# Re-joining the scheme:
If the DWP re-awards your qualifying mobility allowance after you have returned your vehicle, you will unable to re-join the Motability Scheme for six months. This is because Stopped Allowance Support grants are available to help unsuccessful claimants when they leave the Scheme. If you would like to re-join within six months of receiving a Stopped Allowance Support grant, you will need to contact Motability Schemes Customer helpline to discuss your options, which could include paying back part of the Stopped Allowance Support grant.

Hope the above is of some help. Re the appeal, you must get some help, perhaps the local CAB office. In addition, you need to get your GP on-side, get something on their system, ask for a letter? I’m so sorry for you but you mustn’t let them win. They hope you run out of energy and give up. Don’t. Unfit for purpose. Private sector sadly. Best of luck anyway.
March 21, 2020 at 8:52 pm #109846It really does make you wonder if these people get a bonus for getting you refused.
March 21, 2020 at 11:27 pm #109851They have been told to try to get every single application denied as a percentage will just give up and not challenge, it’s criminal.
March 22, 2020 at 12:18 am #109853
PhiljbThere was a rumour going around that they were paid £50 for every assessment that failed, but as i said I’ve never been turned down.
March 22, 2020 at 3:49 pm #109895
martinounder the freedom of inforation act I wounder if you could find out the exact figures if any they get to fail us , I defently do think they do get a bonus of some type
Maybe someone could find out
March 22, 2020 at 6:22 pm #109908Just to reinforce the message. Always appeal DWP dissensions.
PIP and ESA appeal success rates hold steady
The latest Tribunal Service statistics show the success rate for PIP and ESA appeals is holding steady.
The figures cover the quarter from October to December 2019.
They show that the overall success rate for social security claimants who have to go all the way to an appeal hearing has risen to 71%, up 1% on the same period a year ago.
The success rate for ESA appeals is now 77%, the same as the last quarter and up 3% on a year ago.
The success rate for PIP appeals is now 76%, the same as the last quarter and up 2% on a year ago.
For DLA the success rate is now 68%, down 1% on last quarter and for UC it is 62%, up 1% on last quarter.
The backlog of social security appeals has fallen by 24%.
But the time taken for a case to come to hearing has risen to 32 weeks, an increase of two weeks on a year ago.
There has been a 23% rise in the number of PIP appeals and a 95% rise in UC appeals.
There has been a huge fall of 68% in ESA appeals.
PIP made up 58% of all social security appeals.

KatSo after many years of no’s I was finally awarded PIP via the final tribunal! I was ill and (we all know how deteriorating and detrimental the wait for services can be) thankfully I was helped by my niece and my daughter obtaining a little diary and 180 pages of an assortment from proof of pain management and mental health, physio etc, gp referrals are not enough. So Keep At it.
I’ve 2 questions
1. Award period of 2018-2022 both enhanced, does this mean I’m unable to apply for a mobility car as they’re a minimum of 3 years?
2. I received the call on a Saturday morning telling me I did not need help and left me to it! No Q&A no support, let down even Bad move for me.
Is it to late to appeal the decision of what income I was forced to end? The dates go back to before the forced move?
July 3, 2020 at 9:43 pm #117683
SaintsmanIt has happened to me twice. The first time I was given my award back after MR but still too late to keep my car. There weretwere a few things that stood out that DWP couldn’t miss. The doctor (it was a real doctor) said I was left handed, I shook hands with my left hand since my right arm was in a sling. He declared that I could “sit, stand and climb on the sofa” something that made no sense, finally he could tell I was able to walk a great distance as he could see the callouses on my feet by the way my socks looked on my feet. When I got the MR report it had his name and practice number, I reported him to the GMC, he was not struck off but received a severe reprimand.
It’s heartbreaking when you lose your transport but fight them, go to appeal and rub their noses in it. It will take time but I know you’ll get there.

MattSo sorry to read your post. I strongly advise an appointment (via telephone/webchat) with your local Welfare Rights (WR) officer as they are independent and will provide you with free representation at a tribunal. WR are also fantastic with the wording of you application/appeal which can be fundamental in some cases.
Finally check with DWP as I’m sure it’s still the case that they are obligated to continue to pay benefits based on your previous award whilst waiting for an appeal to be heard (which could be months). During this time you should be able to keep your vehicle.
Also, give your local supermarket a call. They may be able to allocate you a priority delivery slot based on your circumstances. Very based of luck.

ZoeThis is awful but unfortunately not uncommon. I had my DLA to PIP done and the lies in the report were awful my husband couldn’t believe it as he done all the talking and she said I did but I had warned him the lie beforehand and he said they don’t, so the report was a shock.
Thankfully thecthe manager who ignored the report and contacted my OT who sent a great report and I stayed on the same award. I am medically retired from a government job so I think that might have helped. What I must say is that there are amazing support groups online that help people with preparing for the assessment and appeals, whether it be advice or files that show how you should word your answers etc. So I would definitely join one of them and you shouldn’t pay for it either. This group on Facebook is very helpful with all stages of the process and many have success at MR thanks to the help. I do think that DLA/PIP should not be stopped while people are challenging the decision and maybe an assessment rate could be given which would mean people wouldn’t loose their car etc in the process until it was final due to the high numbers of overturned decisions.July 4, 2020 at 2:59 am #117698All these assessments should be filmed to stop this from happening. I don’t know how they sleep at night.

AdeApplying for PIP is extremely stressful. If you apply for PIP it is much better to do it though an advisor. Someone who knows HOOW to fill in a form, you should use Citizens Advice is possible.
I was lucky, and used there is an excellent Benefits Advisor in my local Maggies centre, and since she started the job 2 years ago, she has obtained over 2 million in benefits for the customers. Just by filling out the forms correctly.July 4, 2020 at 4:34 pm #117784
MattCorrect wording on your form (application or appeal) is VITAL. Even if you are very competent and form-filling, still seek support from CA or WR. Absolutely worth the extra phone call/email.
Although a different state benefit, I worked in my local Housing Benefit office for 7 years and seen the difference first hand.
July 4, 2020 at 4:59 pm #117785
CarlI can suggest you contact citezens advice, they have advisors who specifically deal with pip appeals. With their assistance I won on appeal without even attending the tribunal. The assessor and dwp were clearly negligent as their report were full of lies.
