Handing car back early due to change of circumstances, any advice?

      Hi,

      We picked up a cat in June 24, we had to change quickly from a car we had from the previous November 23, as VW could not solve a technical issue with it, even after 8 attempt, Motability did allow us to change due to this issue with a full refund of our AP, which was good, as I am guessing because it was a problem with the vehicle.

      The current vehicle was one of very few that were actually available in the timescale we had, most cars at the time were on a 3-6 months lead time, so we chose a Mercedes CLA 200, lovely car, but not what we were after, but didn’t have much choice, the dealership were great and did what they could to make sure it was OK for my wife to get in and out of, due to her mobility issues and to be honest she didn’t really have any, but since we picked it up, she had an operation on her shoulder, which they said would “resolve everything” but guess what, it hasn’t and she has got worse and is now struggling to get in and out of the car and is in really bad pain and discomfort doing so. She is due to have another procedure in May, however it is one of the same ones she had previous to the operation in September, which didn’t work and is why she had to have the operation under general anaesthetic, so a fairly major one.

       

      Anyway, we are just in the process of contacting Motability to see what they will allow, so I was wondering if anyone had any recent experiences of this to at least pre warn us of any potential issues we may encounter.

      What is the likely hood of them agreeing to this?

      What hoops will we have to jump through?

      What would be the situation with the £4K advance payment we paid only 10 months ago, would we get a proportion of this back, as without it we can’t afford a new car which would be suitable?

      Any or all thoughts and advice would be appreciated

        They are normally pretty good in situations like this TBH.

        Just explain your wife is struglling to get in & out of the car due to severe pain and an operation hasn’t helped, requiring her to need another one later in the year.

        They may charge an admin fee for allowing you to change which can be upto £250 but, in cases like this its normally only small £50 or so, if any at all.

        You will get a pro rata refund on the AP you paid for the CLA.

          You’ll also forfeit your good condition bonus, and you’ll not get the advance payment, whatever it is now called.

          I swapped cars early three months ago and it was painless. I guess as @kezo says, you’ll pay £250 or maybe just £50 to break out of the contract. I paid £50 and it was my first time cancelling a contract.

          Fingers crossed you’ll get the same treatment (or better?).
