What’s peoples opinion on the introduction of Smart Drive for vehicles which have any under 30’s, either the recipient or named drivers.

Looking at comments on MO’s Facebook page, this one comment drew my attention, in that under the privacy policy, it states it can track you in other vehicles (As previously quoted) Comment on FB: “So will all named drivers be required to have this app, and does it need to be active when we are not in the vehicle, My point remains, if it’s eventually rolled out across the board, the car will be returned!
They will lose too many customers with this nonsense. A 2nd phone for the app and leave it home
I was unsure about raising this again, but all I am interested in is whether anyone has the tracker and app working and how are they finding it. I absolutely understand everyone’s nervousness and various thoughts about how they may circumnavigate using the app but really I am simply interested in real life examples of how it’s working for early adopters. Thanks

There have been no further comments on Motability’s Facebook page suggesting anyone has had one and not seen anyone comment on the forum about recieving one.

If, I was under 30 (wishfull thinking) or had a driver under 30, I would certainly challenge and go to the Ombudsman if necessary, who would almost certainly see it a breach of of data protection, especially, the continued monitoring, when not in the scheme car. It’s up to those in this situation to challenge it!
Sadly not how it works.
From a legal standpoint, there is nothing wrong. It’s not a breach of data protection – or rather, data protection isn’t an all-shielding umbrella against any intrusion.
Let me get out of the way that i think that this nonsense is awful, and i will leave the scheme once i am required to use that app (ie. if it gets expanded to all of us).
For the legal standpoint: the law requires a lawful basis for them to collect data, which they have. They do have a legitimate interest (doesn’t matter how much i don’t think they do, before the law, they do) in that data (for the insurance part). As for the passenger part, this is simply due to how the entire scheme is set up.
There’s two options. Either the phone tracks all journeys, or it requires you to manually “start” the app every time you drive your car. The app only knows you’re moving, not whether or not you’re the driver. Imagine the administrative nightmare it would be to constantly check everyone’s app against the mileage of the car, to see if they “manually start the app” every time they drive, and terminate leases based on that.
This is the only workable approach (and it’s legal) – it’s just absolutely dogshit for customers, and i don’t think they’re doing themselves a favour there.
Lastly.. in the end, Motability isn’t legally required to allow you access to the car in the first place. Based on that alone there’s no legal case. You’re not entitled to a lease, and it’s not discriminatory against younger drivers (and never has been, since all insurers treat young drivers differently – it doesn’t breach the EA2010).
So.. Don’t get this wrong, as i said, i think this is absolutely awful, but people shouldn’t get their hopes or tempers up citing laws. This is perfectly legal, and you will not find an ombudsman or court that’ll side with you on legal grounds. They will all agree that this is bollocks, but that legally, there’s nothing to be done.
The only option is to vote with your feet, and let MB know by sending an email too. They may get cold feet at some point – but this will only change if this change leads to loss of money rather than cost savings in insurance.

I can see it states it doesn’t impact the lease but then why bother collect that information? I can see it being used down the line with perhaps more stringent policies for certain people.
December 1, 2025 at 12:57 am #318710This is a pain in the bum for me. I’m due a WAV in the new year, fingers crossed. I have one support worker who is amazing but under the age of 30, she doesn’t fore see it as an issue. My other two support workers, again amazing are in there 50s, one has a phone that so old it doest even have bluetooth and the other said she will point blank refuse to instal the app due to privacy issue.
What do I even do if support workers refuse? It took me ages to get the right support workers for my needs and this potentially could leave me without access to hospitals, social or out door life in general if anyone refuse the app.
December 1, 2025 at 1:00 am #318711I saw that and imminently thought my run down to Port Talbot Hospital once a month, it an 90min journey, not once have my support workers ever felt the need to stop after an hour and if they have to its just going to make the day even longer, plus having to find somewhere to stop on the M4.
December 1, 2025 at 9:54 am #318714Yep the control of journeys, both time and number is just a crazy situation and the measuring of number of journeys is to be frank going to cause a whole load of anxiety.
I do get that it wont affect your overall score on drive smart (but will stop you getting rewards), but in my opinion
Max journey length should be set at 2 hours (which is the normally accepted sensible time before taking a break)
There should be NO measuring of number of journeys
Crazy thing is if you have a 90 minute trip by the time you have stopped on outwards and return you will have used four of your six daily journeys!
The young adult I support has a weekly 2hrs 5/10 min journey which we share the driving for so will use all six daily journeys on the single trip thus restricting him from using the car again that day (which he is paying £4k a year for).
So it is the number of journeys restriction I think is really unfair and would encourage people to write to their MP about.

December 1, 2025 at 9:57 am #318716If you are in the car it will connect to your phone and assume you are driving. There must be someone with the app in the car every time its used.
If two drivers both with the App are in the car, it should connect to the first driver in the car (but may not)

The one drive under 30 has an appropriate phone but my two other support workers are the issue.
One has a phone so old, Noah used it on his ark and the other refuses due to privacy concerns with tracking away from my van and it tracking her movements with other clients.
Ive had these support workers for several years so I’m left with the choice of either find another team, get rid of the under 30 support worker or leave the Van to just sit and plan my life around the one support worker able and willing to connect to the device.
Defiantly a pain in the bum if your life relies on support workers to drive you.

I am unsure that they will suggest an workable solution other than find other drivers which is hardly helpful.
The app could be disabled when not in your car but what a faff and hardly the point.
Horrible situation for you even more so because I know only to well how difficult it is to find a good PA

The app works on most smartphones, but not all Android models. Phones like Xiaomi, Oppo, Huawei, and others that don’t fully support Google Play services will not be compatible.
