Cancellation of order pre build, optional extras payment refund

Firstly I apologise if this has been asked before, I’ve searched but couldn’t find anything specific to the optional extras payment.

I placed an order for a VW Tayron a couple of months ago, delivery is anticipated March/April. At time of ordering the dealer requested payment for the optional extras so I paid this to them.

Since then the Motability scheme has obviously changed significantly and as a first time user this makes me very nervous about where things are headed with regards choice and future cost increases for vat etc. I know my first lease won’t be affected but its future ones that worry me.

So, my question is….if I were to cancel the order will I get the payment for optional extras returned by the dealership.

I have asked the dealership but they are worryingly unresponsive, they were very responsive when it came to placing the order but not now I’m asked about my rights to my deposit back.

No judgement please just asking if anyone knows my rights to the money back for the optional extras. Note this is pre build if that makes a difference.

      Many thanks for any advice.

      Mark

Motability cannot return money payed outside the advance payment. They will sometimes in the case of a bad experience with a faulty car such as my last car. But I was very lucky to get the money back. Your point of contact is with the VW dealer, and contact Motability for advice but I imagine they can only pressure the dealer to play fair and won’t actually pay out. What was optioned and how much did it come to?

If the car has not been built yet they are out no money. So in that case they should give the money you paid for extras back. If the car is built with the extras you asked for then no they will not give it back.

Sorry, you’ve made an order which you are happy with and will give you certainty for 3 years but are worried about what happens after 3 years so want to cancel a perfectly acceptable deal? Yes?

I tend to agree, just stick with this order and then decide in three years time whether to stay in the scheme or not

Its important to note that you have not entered into a legally binding agreement until you enter your PIN number upon collection.

Providing the vehicle has not gone into factory production, the dealer is not out of pocket, should you cancel and should return the deposit.

There is planty advice on this across the site, including where dealers who put up a fight but ultimately refunded, as no contract  had yet being signed “search bar”.

Wow…just wow….sarcasm and judgement when i specifically asked for no judgement?! I asked for advice from what I’d hoped would be friendly forum members on what my rights might be for a refund of a deposit for optional extras on a vehicle not yet built. I didn’t ask for an opinion on my life choices for the next 3+ years. I’m not saying that its a bad deal for the next 3 years, I didn’t even suggest that, nor did I ask for anyone’s opinion on that specific point. For someone new to the scheme its a huge decision, not one I take lightly and one would hope that friendly forum members would be understanding of that fact. I don’t just make decisions for the next 3 years, I plan longer term but that’s just me and nobody else’s business but mine….hence I’d only asked for advice on a specific question of a potential refund of a deposit for optional extras. Perhaps when you don’t have something nice (or even relevant) to say maybe next time say nothing at all? Your sarcasm and unwelcome comments on things that are none of your business tarnish the whole point of a forum to share helpful information. Maybe the next time someone asks for advice on a refund of a deposit for optional extras, consider whether you have any advice relevant to the specific question, if not maybe move on and read another post….or maybe just jump in there and sarcastically pull apart someone’s personal decisions without consideration for their mental wellbeing. My teachers used to say when the question is 1+1= ….don’t give the answer for the square root of 9 just because you know the answer to that. So much for us disabled people having eachothers backs.

I see neither sarcasm or judgement. I see people offering support in backing your decision and asking you not to worry about the Scheme in three years time. It was certainly a very different proposition three years ago compared to today.

Agree. After posting I felt happy that it would help re-enforce that if he stuck to his original decision there was nothing to worry about. There was not one iota of malice or judgment from me, so i feel very sad about the long rant but I have broad shoulders and will get over it.

The OP  asked for advice, and they did receive sound and accurate advice.

The only sarcasm and judgement came from the OP?

Thats the way I see it. Maybe I,m wrong? But it was good advice.

@MB72 You are entitled to your money back. At no stage do we ever enter into a legally binding contract with a dealership. The only contract is between you and Motability Operations, and even that doesn’t come into effect until you enter the PIN on the day that you take delivery. There have been occasions in the past where one or two dealerships have played hard to get about refunding deposits, but by quoting the above people have eventually got their money back.

As others have said, the adverse changes to Motabilty don’t come into force until next summer, so you won’t be affected with this car. However, you might decide to source a car privately now if you think that you’ll leave the scheme after just one car, so that you continue to own a car and have a deposit next time, but only you can decide which option is right for you.
