It is interesting that Motability’s website, regarding ‘Ending your agreement Early’ still states:
”If there is a valid reason for cancelling your agreement, for example, if your mobility needs have changed and the car is no longer suitable, please call our Customer Services team on 0300 456 4566
If you do cancel, there will be an administration fee to cover our costs and you will not be eligible for a Good Condition bonus. Once you have returned your vehicle any Advance Payment you have paid may be refunded to you on a pro-rata basis. Please contact us as soon as possible to discuss your needs”.
However, if, as you say, there has been a change in the t&c’s, meaning no return of the pro-rata AP, then it may well affect the choice of vehicle a customer orders. For example, who will order a £2k-£3k AP vehicle, knowing that if they do have to return it for any reason, there will be no pro-rata refund of the AP.
In fact, some people may already be in the early/mid stages of their contract with an expensive AP vehicle, believing that, if for any unexpected reason they needed to return it, the AP would be refunded pro-rata, as those conditions were in force at the time the contract was ‘signed’ by the input of the PIN.
It is certainly one that could be argued over in court!
